All pool measurements are approximate external measurements, depths are approximate measurements All swimming pool gelocoat colours will have a slight variance in shade, colour or appearance due to  manufacturing situations and conditions. Selecting and viewing colours or products off websites should be selected at your authorized Atlantic Pools and Spa’s dealer as resolutions vary on different computers and will not be accurate.

Atlantic Pools and Spa’s recommend in the event of a dispute between an authorized dealer and client, all information relating to the dispute is to be directed to the authorized dealer only. Atlantic Pools and Spa’s do not accept 2nd or 3rd party information and do not accept any liabilities. Atlantic Pools and spa’s do not comment on a private dealer or their clients right to privacy.

INFORMATION TRANSFER/CORRESPONDENCE  
Information transfer: All correspondence with respect to all documents and information must be in writing. To avoid misunderstandings, no verbal agreements will be entered into or acknowledged.
Due to unforeseen circumstances in production & supply / manufacturers and delivery schedules that are beyond control of. Factory Direct Pools & Spas Pty Ltd reserves the right to change without notice, the right to add and purchase at the sole discretion of Factory Direct Pools and Spa’s Pty Ltd, any raw or any other materials required to make our Fibreglass products above Australian Standards without prior notice. All rights reserved to Factory Direct Pools and Spa’s Pty Ltd

INTELLECTUAL PROPERTY RIGHTS
The customer hereby agrees and recognises that to Factory Direct Pools and Spa’s Pty Ltd is the owner, assignee or licensee of various intellectual property rights in Australia & around the world including but not limited to, swimming pool designs, water features, trade names, logo’s and all confidential information relating to all goods.
The customer agrees and undertakes that neither it, nor any agent, contractor, third parties, subsidiary or representative shall in any way copy, duplicate, reproduce, modify, remove, cover up or mutilate in any manner the Intellectual Property of Factory Direct Pools and Spa’s Pty Ltd Including but not limited to images, logos and all information.

Force Majeure/Disclaimer
to Factory Direct Pools and Spa’s Pty Ltd will not be held liable or be held responsible for any situations or people beyond normal control.
Including but not limited to;

* Natural disasters (earthquakes, hurricanes, floods, excessive wind, excessive rain, hail, torrential rain)
* Acts of God
* Wars, strikes, fires, government restrictions, power failures, riots or any other major upheaval.
* Atlantic Pools and Spa’s Pty Ltd will not be held responsible or liable for performance, monies or product failures of customers, 2nd or 3rd parties outside their control, including but not limited to:

# Suppliers of products and goods.
# Freight delays
# Transit delays
# Machinery breakdowns
# License delays
# Traffic Delays
# Weight transfer & ground pressure due to machinery including but not limited to :
Excavators, water trucks , tip trucks, bobcats, cranes, or any other heavy machinery that exerts downward or any other force on concrete, drive ways, tiles, paving or any other materials.

The order & purchase of any Atlantic Pools and Spa’s Pty Ltd products and goods constitutes acceptance of Atlantic Pools and Spa’s terms and conditions.(see your authorized dealer for terms and conditions-supplied at time of contract signing)

Atlantic Pools and Spa’s Pty Ltd shall in no event be liable under any circumstances for any personal injury, property damage, direct, indirect, special, incidental or consequential damage or losses of any kind or nature arising from or related to the performance or supply of the Fibreglass Composite Pool by any authorised dealers. Any claims must be made to the dealer directly involved. Atlantic Pools and spa’s do not mediate or comment on situations that arise for dealers or clients in dispute. Any legal advice should be obtained independently by a legal professional.
